Terms of Engagement
Welcome to Educom International Ltd. (referred to as “Educom,” “we,” “us,” or “our”). By engaging our services, you (the “Applicant”) agree to comply with the terms outlined in this document. These terms govern your use of our services, including but not limited to application assistance, advisory services, and data management.
Definitions
Applicant: An individual seeking our services for applications to colleges, universities, or schools.
Guardian: A parent or legal representative responsible for the Applicant if they are under 18 years of age.
Institution(s): Universities, colleges, or other educational providers promoted by Educom.
Course(s): Academic or professional programs applied for on the Applicant’s behalf.
Service Fees: Payments made to Educom for services rendered.
Third-Party Service Providers: Vendors or consultants involved in delivering or enhancing our services.
Services Provided
Educom offers the following services:
Guidance on selecting suitable universities, colleges, and courses.
Assistance with application preparation and submission.
Advisory support for personal statements and related documents.
Coordination with Institutions to address additional requirements.
Assistance with visa applications as needed.
Advisory support for accommodation arrangements.
Educom will use reasonable efforts to facilitate admissions but cannot guarantee acceptance into any Institution or Course.
Applicant Obligations
To utilize our services effectively, the Applicant agrees to:
Provide accurate personal information, including name, address, contact details, and identification documents.
Submit all required documents for applications in a timely manner.
Pay service fees as outlined in the quotation provided and any additional fees required by Institutions, including application fees, deposits, or tuition.
Review and approve application details before submission.
Fees and Payments
Service Fees are non-refundable unless otherwise specified in a written agreement.
Fees charged by Institutions, including application and administrative costs, are separate and payable directly to the respective Institution.
Use and Disclosure of Personal Information
We collect and use personal data in accordance with the UK Data Protection Act 1998, the EU General Data Protection Regulation (GDPR), and other applicable laws.
5.1 Data Collection
We collect information directly provided by the Applicant and from other sources, such as public databases and social media platforms.
5.2 Data Usage
Your personal data is used for the following purposes:
Facilitating university and course applications.
Sending administrative updates and promotional communications.
Enhancing our services through data analysis and usage trends.
5.3 Data Sharing
We may share your data in the following circumstances:
With Institutions for application processing.
With Third-Party Service Providers for service delivery and improvement.
To comply with legal obligations or enforce our terms.
With business partners, consultants, and affiliates where necessary.
5.4 International Data Transfers
Your data may be transferred, stored, and processed in countries outside your own. While we implement security measures to protect your data, you are advised to use our services within a secure environment.
Cookies and Tracking
We use cookies and similar technologies to enhance website functionality and analyze user behavior. By using our website, you consent to the use of these technologies as outlined in our Cookie Policy.
Refund Policy
Service Fees paid to Educom are non-refundable unless explicitly stated in the quotation or agreement.
Limitation of Liability
Educom is not liable for:
Admission decisions made by Institutions.
Delays or disruptions caused by third-party services or unforeseen circumstances.
Dispute Resolution and Governing Law
Governing Law: These terms will be governed by the laws of the jurisdiction in which Educom operates.
Dispute Resolution: In the event of a dispute, both parties agree to resolve the matter through mediation. If mediation fails, arbitration will be the next step. If the dispute is not resolved through arbitration, it may be taken to court in the appropriate jurisdiction.
Force Majeure
Educom will not be held responsible for delays or failure to perform services due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, or other unforeseen circumstances.
Termination Clause
Either party may terminate this agreement with written notice. In the event of termination:
Educom will retain fees for services already provided.
If the termination is due to a breach by Educom, a pro-rated refund may be provided for unrendered services.
Termination does not affect any rights or obligations that have accrued up to the date of termination.
Indemnification
The Applicant agrees to indemnify and hold Educom harmless from any claims, damages, or legal actions arising from the Applicant’s misuse of services or failure to comply with the terms of this agreement.
Limitation of Scope of Service
Educom’s services are intended to assist with the application process, but Educom does not guarantee admission to any Institution or approval of visa applications. It is the Applicant’s responsibility to ensure that all necessary qualifications and criteria are met.
Intellectual Property
Educom retains ownership of all proprietary materials, documents, and content provided through our services. The Applicant is granted a limited, non-transferable right to use these materials solely for the purpose of utilizing Educom’s services.
Conflict of Interest
In the event that a conflict of interest arises between Educom, the Applicant, and any Institution or Third-Party Service Provider, Educom will disclose the conflict and take appropriate measures to resolve it in a manner that is fair and transparent to all parties involved.
Communication and Notices
Communication: All communication between Educom and the Applicant will be conducted via email, telephone, or written notice, as necessary. The Applicant must promptly notify Educom of any changes to contact details.
Notices: Notices will be considered delivered when sent to the email address provided by the Applicant or when mailed to the address on file.
User Responsibilities Regarding Third-Party Content
Educom is not responsible for third-party content, such as institutional websites or services provided by other consultants, which may affect the Applicant’s application process. The Applicant is advised to verify all third-party information independently.
Amendments
We reserve the right to update these Terms of Engagement at any time. Any changes will be communicated via our website or email, and the Applicant’s continued use of our services constitutes acceptance of those changes.
